Personal Injury
Forecasting an individual's expected lifetime wage loss and expressing them in present value are the key issues Dr. Carroll addresses in personal injury cases. He uses a large database called the Current Population Survey (CPS) to relate earnings to age, occupation, education, ethnicity and disability statues. This allows him to estimate earning capacity for individuals with little or no earnings history- children, housewives, and those relocating or changing careers.
Wrongful Death
Wrongful death cases require similar analysis but are broadened to also address how much an individual would have been expected to consume over his/her lifetime, leaving the net accumulations to an estate.
Economic Discrimination
Discrimination cases involve conducting demographic and wage analysis of the firm's employment practices as compared to its relevant employment area using the CPS database.
Business Damages
Dr. Carroll estimates business damages by comparing two scenarios, comparing what profits would have been without the injury, with what actual earnings have been since the injury. Using the two trends he can estimate likely future damages.
Construction Defect
There is a legitimate need to compensate homeowners when builders breach their contract to provide safe, healthy, and sound houses and condominiums. Nevertheless, plaintiffs’ attorneys often err by using biased sampling techniques when they extrapolate damages from known defects in selected properties to an entire development. Dr. Carroll has testified for defendants in numerous construction defect cases about the distortions that inappropriate statistical inference can generate. He also stands ready to assist plaintiffs’ attorneys in the appropriate procedures of sample selection and defect extrapolation.
